SACRAMENTO - On May 28, the California Assembly approved AB2279 (Leno) by a vote of 41-35.
The bill states that, with the exception of safety-sensitive positions, "it is unlawful for an employer to discriminate against a person in hiring, termination, or any term or condition of employment or otherwise penalize a person, if the discrimination is based upon either of the following:
(1) The person's status as a qualified patient. (2) The person's positive drug test for marijuana, provided the person is a qualified patient and the medical use of marijuana."
Representative Leno introduced the bill after the California Supreme Court ruled against a medical marijuana patient seeking employment rights in January 2008.
The resolution will now go to the California Senate.
